Can you get a Quickie Divorce Without your Spouse’s Consent?

Many people are looking to save money when getting a divorce and it should therefore come as no surprise to hear that potential customers regularly ask us whether or not they can use our services when their husband/wife does not agree to a divorce or they are simply no longer in contact with them and unable to ascertain whether or not they would be in agreement as a result. The answer, fortunately, is yes, but patience will be required as the couple in question will need to have been separated for over five years. Quickie Divorce are able to help under these circumstances because, when a petition cites five-year separation as the grounds for divorce, then both parties consent is not required and the application can proceed provided the Respondent does not contest it. As it can cost upwards of £100 to contest a divorce, it is extremely rare for Respondents to contest proceedings. It should be added, however, that the courts will need to serve documents on the Respondent in order to ensure that they are aware of the fact that their spouse is divorcing them and that the Petitioner will incur additional court fees as a result.
