Is a DIY Divorce Right for You?

Yesterday, the final version of the Family Justice Review was published for all to see and amongst proposals concerning parental rights, the use of mediation and judicial structures was a suggestion that Quickie Divorce found to be particularly interesting. In an attempt to keep divorce cases which could otherwise be resolved amicably out of the family courts, the government have been advised to encourage couples to utilise the services offered by websites offering DIY divorce. Seeing as how we’re the largest and most trusted of all such sites, I’m sure that you can imagine just how thrilled we all were with this recommendation. Following us having fully taken stock of this recommendation, however, we realised that we should point a few things out. The majority of couples that are seeking a divorce may well benefit from services such as ours. Our infrastructure allows us to offer couples a quick divorce that is both inexpensive and comprehensive, but there are several questions that an individual must ask themselves before deciding on whether or not a DIY or online divorce is right for them. Firstly, if either spouse intends to defend the divorce, then a DIY divorce is not suitable. This may be unlikely, but if a divorce is contested in any way, then an online company will be unable to help and a solicitor should be instructed. Jurisdiction is equally important. In order to file for divorce in the UK, then at least one spouse must possess a significant link to the country. Determining jurisdiction can be difficult as a result and whilst an online divorce provider may be able to assist you, we would strongly recommend that you contact them beforehand in order to discuss your situation if you have any concerns regarding this matter. Finally, both spouses must agree to all contentious issues, including the division of assets and childcare. More often than not, a DIY divorce is unsuitable because couples cannot reach agreements regarding these matters. Be careful which company you choose if you meet the criteria described above and decided to use an online divorce provider, though. Many offer services that are not up to scratch and before deciding to trust them you should look up a few facts. The very first thing that you should do is make sure that they’re not run by paralegals or legal assistants. A divorce is one of the most traumatic events that a person can experience and the peace of mind that is afforded when you know that your divorce is being overseen by a solicitor is quite literally priceless. Additionally, you should ensure that the company is voluntarily regulated as, despite operating within the legal sphere, online divorce providers are not subjected to official regulation. If you choose a company that is voluntarily regulated then you can be certain that you are dealing with a reputable company.
