Under normal circumstances: yes, you will be informed if your spouse files for a divorce. Whilst it is rare for one spouse to divorce another without their knowledge, however, it is indeed possible for a divorce to proceed without one spouse being notified under certain circumstances. If, for example, both parties lose contact with one another to the extent where they are no longer aware of the others whereabouts, then it is possible for one to divorce the other without their knowledge provided they obtain permission from the court. The court will only grant permission if the Petitioner is able to show that they have made every reasonable effort to locate their spouse and have still been unsuccessful. Should the court agree that every reasonable effort has been made to locate the missing spouse, the divorce will go through without this person’s knowledge.
