How to Prove Unreasonable Behaviour in Divorce

Provided the divorce truly is uncontested, then the answer is very straightforward. When a couple agree to a divorce, then all that is required to prove unreasonable behaviour or adultery is the parties’ agreement. Following the Petitioner having filed their documentation with the court, copies of these – including the petition describing the unreasonable behaviour or adultery – are sent to the Respondent. Provided that the Respondent returns these documents and indicates that they agree to the divorce, as well as the reasons for it, then the court will not require any further evidence.
