Divorce papers: where to find them and how to complete them

Divorce papers; divorce documents; divorce petitions; decree nisi – there are any number of things people type into search engines when they’re trying to find the forms they’ll need to file for a divorce. Whatever term you enter, though, finding a resource that both tells you where you can get the forms and that states exactly which ones you’re going to need to complete is a surprisingly difficult task.

With this in mind, Quickie Divorce thought we’d prepare a comprehensive post that’ll provide you with this information.

Where to get the papers

Each of the documents we describe below can be downloaded from this website and, to help you find exactly what you need, we’ll include both the form’s title and reference number in the subheadings below:

Application for a divorce, dissolution or (judicial) separation (D8)

This form will need to be submitted to the court in order to start the divorce process. It is largely comprised of basic, personal information such as names, dates of birth etc. but a short statement will need to be prepared within section 7 of the form if adultery, unreasonable behaviour or desertion are being relied upon.

Statement in support of divorce/dissolution/(judicial) separation (D80A/D80B/D80C/D80D/D80E)

Again, the content that will need to be included in each of these forms is very straightforward. If you are relying on two or five-year separation, though, you will need to provide the addresses of the properties you and your spouse have lived in following your date of separation, along with the dates on which you moved in to and, if applicable, out of them. So, it might be worth looking for old correspondence to work it all out beforehand.

Also, you may have noticed that we’ve included five separate form numbers in the subheading above. This is because a different form will need to be completed depending on what reasons you’re relying on. Here’s a breakdown of which form you’ll need for each potential reason:

Adultery – D80A

Unreasonable Behaviour – D80B

Desertion – D80C

Two-Year-Separation with Consent – D80D

Five-Year-Separation – D80E

Application for a decree nisi/conditional order or (judicial) separation decree/order (D84)

Another straightforward form here. All you need to do is cross out the parts that don’t apply, sign it, date it and send it to the court.

Notice of application for decree nisi to be made absolute or conditional order to be made final (D36)

To complete this form, all you’ll need is the piece of court correspondence that confirms the date on which your decree nisi was granted (as you’ll need to enter it into the form), but that’s it. Other than that, the only thing you’ll need to do is sign the form, date it and, once again, return it to the court. Just make sure that the date you put is at least six weeks and one day AFTER the date your decree nisi was granted and that you don’t send the completed form to the courts before then, too.
