Can You Divorce Online?

If you and your spouse have agreed to a divorce, then you could save thousands of pounds in solicitors’ fees getting a divorce online. But are you able to use such a service? Firstly, and as previously stated, you and your spouse must agree (or consent, if you prefer) to the divorce. You may be able to circumvent this if you have been separated for over five years or your spouse has behaved unreasonably, but we would recommend that a solicitor is instructed in the event of one party wishing to contest the divorce. Additionally, we would not recommend an online divorce if there are children involved and you and your spouse cannot come to an agreement regarding childcare arrangements or on how communal assets such as properties and savings should be divided. Should either of these circumstances apply, however, then you could potentially use a solicitor in order to negotiate and make legally binding contracts to finalise these matters before using a far cheaper online divorce service to dissolve your marriage.
