Divorce Advice: Will the Courts Need Proof of Income?

The courts will not require any proof of your income when you file for a divorce unless you request that they waive or reduce their fees when making your submission. If you make such a request, then you will need to provide the courts with copies of your wage slips, bank statements and letters from agencies such as the Department for Work and Pensions or Jobcentre Plus if you receive benefits.

If you are also applying for a Clean Break in order to make any agreements that you and your spouse have reached legally binding, you will need to submit documentation outlining both your and your spouse’s financial circumstances as well as the documentation describing your agreement.

Neither party will be required to provide any further evidence of their income in these circumstances, but both parties will be required to sign this document and swear that the information contained within it is accurate before submitting it.

Following this, if it is later discovered that either party was dishonest and failed to disclose all of their assets, income etc. then the agreement will become null and void and the dishonest party may also face penalties for being in contempt of court.
