40% of Solicitors’ Divorce Petitions Contain Errors

Divorce Solicitors – who have long proclaimed that their services are superior to those offered by their competitors – have been dealt a blow following it having been revealed that four out of every ten divorce petitions they send to court are returned to them due to errors.

This finding, which comes directly from HMCTS, was revealed during a briefing concerning the potential migration of all non-contested divorce matters that do not require a hearing to a single ‘divorce-hub’ located in Bury St Edmunds.

During the briefing solicitor Tony Roe stated that HMCTS had informed him that 40% of all solicitor drafted divorce petitions need to be returned due to errors. The most common mistakes made by solicitors, according to HMCTS, include missing and incorrect details, a failure to enclose necessary fees, and a lack of signatures.

This news is, of course, a blow to legal professionals who have long proclaimed that online divorce providers such as Quickie Divorce provide an inferior service. Such individuals argue that they are far less likely to make errors and that choosing an online service will almost certainly prove to be a false economy; these findings prove that this is clearly not the case.

HMCTS’s revelation is further bad news for divorce lawyers, with the results of a survey undertaken by the Legal Services Board and Legal Services Consumer Panel having revealed that online divorce services posed no additional risks to clients.

The survey also revealed that people that use online services were three times more likely to recommend such a service when compared to users of traditional divorce solicitors. Clients were also more likely to be satisfied with an online service and also reported a significantly faster service.

Ultimately, it is entirely understandable that solicitors try to leverage their historical position in order to market their services. The findings outlined above reveal, however, that there is no guarantee that clients that instruct solicitors will receive a better service than those that enlist the help of Quickie Divorce. Indeed, they suggest that the opposite may be true!
