‘Divorce Tax’ to be Introduced in Australia

The need to pay a fee to the courts when filing for a divorce may be the cause of much consternation but, whilst many feel that the £410 fee is excessive, it could be worse: they could be suffering a martial breakdown in Australia. Yes, whilst residents of England and Wales will be required to pay a fee of £410 to the courts when filing for a divorce (unless they are in receipt of certain benefits or a low income), the Australian government has recently announced that there were will a substantial, though as yet unspecified, increase to the fees that will need to be paid to their courts, with the press having already deemed this increase the ‘divorce tax’. Unsurprisingly, this decision has been met with criticism, with the country’s opposing Labour party stating that the plan is a “mean-spirited tax on family breakdowns” and that current Prime Minister Tony Abbot ““should be ashamed that he is taking advantage of a vulnerable sector of society to line the government coffers." The incumbent conservative government have previously criticised the country’s high divorce rate – arguing that children of divorce struggle when compared to their peers – and many have claimed that it is this attitude towards marital breakdown that is the driving force behind their decision to raise court fees. The current fee for filing for divorce in Australia is $845 (£431).
